Bombay HC Quashes MPDA Detention Of 4-Month Pregnant Woman, Says Police Failed To Use Normal Legal Remedies

The Bombay High Court has quashed the MPDA detention of four-month pregnant Usha Sakat and ordered her release, observing that police failed to use available remedies under ordinary law. The court found flaws in classifying her as a “bootlegger” based on confidential statements and said authorities could have acted under her existing Rs 50,000 good-behaviour bond.
