The Bombay High Court has ruled that homebuyers withdrawing from a delayed housing project cannot be forced to wait for an Occupation Certificate before receiving a refund. The court upheld an order directing Sanklecha Constructions to return Rs 22.58 lakh with interest from January 1, 2018, holding the refund right under RERA to be absolute and unqualified.
