The Mumbai NCLT dismissed Adamji Investments' Rs 11.73-crore insolvency petition against M Cons Media Marketing, holding that corporate insolvency proceedings cannot be initiated against a company whose name has already been struck off by the RoC. The tribunal also noted that the creditor had not sought restoration of the company's name before filing the plea.
