The Bombay High Court upheld a developer’s decision to terminate a homebuyer’s allotment, ruling that transferring Rs 4.65 lakh to a bank account for stamp duty and registration did not constitute actual payment. The court directed the developer to refund Rs 12.30 lakh paid by the buyer with interest and barred any earnest-money deduction.
